Terms and Conditions of Use

This Terms and Conditions of Use Agreement (“Agreement”) is a legally binding contract between the user (“You”, “Your”) and Monmall Ltd Inc (“Monmall”, “We”, “Us”, or “Our”), a duly registered corporation operating the e-commerce platform accessible at www.monmall.com (the “Platform”). By accessing, browsing, registering on, or otherwise using the Platform, You acknowledge that You have read, understood, and agreed to be bound by all terms, conditions, and provisions contained herein, as well as any future amendments thereto.
1. Acceptance of the Terms
1.1 Your continued access to and use of the Platform constitutes Your conclusive and irrevocable acceptance of this Agreement.
1.2 Should You disagree with any part of this Agreement, Your sole and exclusive remedy is to immediately discontinue use of the Platform.
1.3 The headings herein are for reference purposes only and shall not affect the interpretation of any provision.
2. Eligibility and Account Registration
2.1 You represent and warrant that You are at least eighteen (18) years of age, or possess legal parental/guardian consent, and are fully able and competent to enter into, abide by, and comply with the terms and conditions of this Agreement.
2.2 You undertake to provide accurate, complete, and updated registration information, and to promptly update such information to ensure its accuracy at all times.
2.3 You shall be solely responsible for maintaining the confidentiality of Your login credentials and for any and all activities conducted through Your account.
3. Products, Descriptions, and Availability
3.1 All products, descriptions, specifications, and prices are subject to change at any time without prior notice, at Our sole and absolute discretion.
3.2 The inclusion of any product or service on the Platform at a given time does not imply or warrant that such product or service will be available at any time.
3.3 Monmall reserves the absolute right to limit the quantities of any products or services offered.
4. Pricing, Payment, and Transaction Processing
4.1 All prices displayed on the Platform are quoted in the currency specified therein and are exclusive of applicable duties, taxes, and fees, unless explicitly stated otherwise.
4.2 Payment must be made in full prior to order processing. We accept only such payment methods as indicated on the Platform and reserve the right to refuse any transaction deemed suspicious, incomplete, or in violation of applicable laws.
4.3 All transactions may be subject to anti-fraud verification and Know-Your-Customer (KYC) procedures, which You expressly consent to by placing an order.
5. Shipping, Delivery, and Transfer of Risk
5.1 Delivery timelines indicated on the Platform are indicative only and do not constitute a guarantee of delivery within a specified period.
5.2 Risk of loss or damage to the goods shall pass to You upon Our delivery to the carrier.
5.3 We shall not be held liable for delays caused by acts of God, customs inspections, transportation strikes, or any event beyond Our reasonable control.
6. Returns, Refunds, and Exchanges
6.1 Subject to the exclusions herein, You may request the return, refund, or exchange of a product within seven (7) calendar days from the date of receipt, provided that the product:
(a) is unused, unwashed, and unaltered;
(b) is returned in its original packaging, including all accessories and documentation; and
(c) is accompanied by the original receipt or proof of purchase.
6.2 The following items are strictly non-returnable and non-refundable:
(a) Perishable goods, including but not limited to food items and flowers;
(b) Personal care items such as cosmetics, undergarments, and hygiene products;
(c) Custom-made, special-order, or personalized goods.
6.3 Refunds, where applicable, will be processed using the original payment method within seven (7) to fourteen (14) business days from Our receipt and inspection of the returned item.
6.4 Return shipping costs shall be borne solely by You, unless the return is due to an error attributable to Monmall.
7. Intellectual Property Rights
7.1 All trademarks, service marks, trade names, logos, and related intellectual property appearing on the Platform are the exclusive property of Monmall or its licensors.
7.2 Unauthorized reproduction, modification, distribution, or exploitation of any content from the Platform is strictly prohibited and may result in legal action.
8. Limitation of Liability
8.1 To the maximum extent permitted by applicable law, Monmall, its affiliates, officers, directors, employees, agents, and representatives shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, or business interruption, arising out of or in connection with Your use of the Platform.
9. Governing Law and Dispute Resolution
9.1 This Agreement shall be governed by, and construed in accordance with, the laws of [Insert Country], without regard to its conflict of laws principles.

10. Amendments and Modifications

10.2 Your continued use of the Platform after any such amendments constitutes Your acceptance of the revised Agreement.
11. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, such provision shall be deemed severed, and the remaining provisions shall remain in full force and effect.
